Data Request Guidelines

We are committed to your privacy and trust:

  • We'll notify you if your data is requested, as long as it's legally allowed.
  • We review each data request to ensure it’s valid and legal.
  • We’ll challenge requests we believe are legally flawed.
  • We provide the minimum amount of data necessary.
  • We reject improperly served, incomplete, vague, or overly broad requests.
  • We may disclose data in emergencies to prevent imminent harm.

Types of Data Requests

  1. Data Requests: For official investigations or legal actions, such as subpoenas, court orders, search warrants, and civil investigative demands.
  2. Preservation Requests: To preserve account data for 90 days pending formal legal process.
  3. Emergency Requests: For imminent threats of serious harm or death. Must include an Emergency Data Request Form or a valid court order.
  4. Expedited Requests: Can be processed faster for an additional fee, subject to review.

How to Submit a Data Request

Government Agencies or Law Enforcement:

  • Email requests to support@all8network.com.
  • Include all required details (agency name, agent details, legal process document, etc.).

Civil Matters:

  • Must follow California state or federal court procedures.

Information to Include in Requests:

  • Telephone number or user ID.
  • Specific date or date range (up to 2 months).
  • For government requests: agency name, agent details, legal process document, and more.
  • For civil requests: party’s name, counsel details, legal document, etc.

Response Time and Format

  • We typically respond within 30 days, prioritizing emergency and expedited requests.
  • Responses are sent via email as password-protected files or through a secure download link for larger data.

Available Information

  • Account Information: Basic subscriber details, billing history, additional numbers/extensions, comment logs.
  • Call/Fax/SMS Log Records: Call direction, call ID, dialed number, start/end time, duration.
  • Content of Communications: Faxes, voice messages, SMS content, call recordings, messaging data.

Requests from Non-US Authorities

  • Must follow a Mutual Legal Assistance Treaty (MLAT), letters rogatory, or similar process.

Data Retention

  • Data is normally deleted within 30-45 days after account closure.
  • Customers can delete their own data, which cannot be recovered by All8Network.

Notification to Customers

  • We notify customers of data requests unless legally prohibited.
  • We seek to challenge non-disclosure obligations and inform customers as much as possible.

Fees for Data Requests

To cover the costs of responding to data requests, we charge the following fees (all in USD):

  • Basic Account Info, Billing History, Additional Numbers, Comment Logs: $50 per account.
  • Preservation or Expedited Handling: $100 per account.
  • Call/Fax Log Records: $40/month per account.
  • SMS Log Records: $40/month per account.
  • Content of Communications (e.g., faxes, SMS messages, voice messages, call recordings): $80/month per account.
  • Engineer Time for Messaging Data Requests: $250/hour (minimum 1 hour).
  • Photocopies/facsimiles (over 10 pages): $0.25/page.
  • Notarized Document Requests: $60 plus $10 per signature.
  • Paralegal Time: $190/hour, Engineer Time: $250/hour, Attorney Time: $450/hour (minimum 1 hour).
  • Pen Register/Trap and Trace: Actual cost.
  • Intercept: Actual cost.

Payment Methods:

  • Check: Payable to All8Network LLC, Tax ID # 87-3319794, mailed to our address with "Subpoena Request" and your invoice number.
  • ACH or Wire Transfer: Contact Accounts Payable at 209-800-4310 with your invoice number.
